Clients were charged with Child Abuse Fourth Degree and Assault and Battery after they were accused of leaving their child unattended on a pontoon boat by a group of people who were boating down the same river and docked next to the client’s boat. Despite the fact that the client and family members were a mere 20 feet away, the other boated boarded the client’s pontoon boat and started touching the infant. An argument ensued among the two groups that was videotaped by the other party and sent to news outlets. During a three-day jury trial, Mr. Bartish was able to demonstrate that the other party’s account of what happened on that day was false. Mr. Bartish’s clients were acquitted of all charges after one hour of deliberation.
