Client was charged with criminal conduct in the third degree by estranged wife as they were going through divorce proceedings and a custody battle. Mr. Bartish cross examined the complainant at the preliminary examination, confronted her with proof that some of her testimony elicited by the prosecutor on direct examination was false, and got her to confess to knowingly making a false statement on the stand during the preliminary examination. The district court judge dismissed all charges following the preliminary examination.
