Client was charged with operating under the influence of drugs – third offense after he was pulled over for speeding. At trial, Mr. Bartish used the police body camera video of the arresting officer to demonstrate that his client actually passed the field sobriety tests and that the client was not fleeing the officer but rather was looking for a safe place to pull over on the dark country road. Furthermore, Mr. Bartish was able to demonstrate during his cross examination of the state’s Drug Recognition Expert that his analysis of the client’s indicators was actually incorrect based on the lab results and the DRE manual. Client was acquitted after 30 minutes of deliberation.
